Madonsela recommended that the commission be established by Zuma but that the presiding judge should be chosen by Chief Justice Mogoeng Mogoeng.

Zuma's action in seeking to overturn the recommendation was "ill-advised and reckless" and the application was a "clear non-starter", Mlambo said in a unanimous ruling of the court.

Madonsela said chief justice Mogoeng Mogoeng should set up the inquiry, rather than Zuma, as the president had a conflict of interests.

The president claimed he had not been given an opportunity by the watchdog to respond to some of the allegations in its report.

In a separate case, Judge Mlambo also ruled that Mr Zuma had been unreasonable in trying to use the courts to block the publication of an explosive official report into high-level corruption, known as state capture.

As yet Mr Zuma has not commented on the decision.

Judge President Dunstan Mlambo is handing down judgment in President Jacob Zuma's application to review and set aside former Public Protector Thuli Madonsela's State of Capture report.

"The president shall take all steps, do all things and sign all documents which are necessary to give effect to the remedial action".

The business family of Indian origin is accused of having undue influence over Zuma's government, including power over the appointment of some cabinet ministers.

He said he believed it was "hopeless" for Zuma to consider appealing the judgments.

On Wednesday Mlambo rejected all Zuma's arguments, saying that Madonsela was correct to foresee that the process may be compromised if Zuma selected the judge who would be investigating him, his son Duduzane and his friends, the Guptas.

The commission is to complete its task and present its report within 180 days and Zuma is to submit a copy‚ with an indication of his intentions regarding the implementation‚ to Parliament, within 14 days of its release.
